Offer agreement
1. General Provisions
1.1. This Agreement sets the terms for Users (Buyers) to use the materials and services of the site https://beautybyvi.ca (hereinafter referred to as the Site, website, online store).
1.2. This Agreement, according to Articles 633, 641, and Chapter 63 of the Civil Code of Ukraine, is a public contract (offer) addressed to an unlimited number of persons, regardless of status (individual, legal entity, individual entrepreneur), who wish to purchase goods in the online store https://beautybyvi.ca/.
Sellers of the goods may be other third parties (not the Administration) who use the services of https://beautybyvi.ca/ to sell their goods on the Internet. Information about such sellers is provided by the Administration upon the User's (Buyer's) request.
1.3. Since this Agreement is a public offer, accessing the materials of the Site means that the User (Buyer) is a party to this Agreement.
1.4. The Site Administration (the owner of the site https://beautybyvi.ca/ and/or authorized persons) has the right to unilaterally change the terms of this Agreement at any time. The new or amended Agreement becomes effective after being posted on the Site. If the User disagrees with the changes made, they must refuse access to the Site and stop using the materials and services of the Site.
1.5. The Buyer agrees to this public offer in full and without any reservations when placing an Order on the Site.
1.6. The Visitor (Buyer) agrees that all the terms of the User Agreement are clear to them and they accept them completely and unconditionally.
2. Registration on the Site
2.1. To place orders on the Site, the User (Buyer) can go through the registration procedure and provide the necessary data according to the questionnaire.
2.2. When registering on the Site, the User (Buyer) agrees to provide accurate information about themselves and their contact details for the Site Administration to fulfill its obligations to the User (Buyer) and deliver the paid goods to them.
2.3. During the registration process on the Site, the User (Buyer) specifies a login (their email) and password, for the security of which they are responsible. The User (Buyer) agrees not to disclose the login and password specified during registration to third parties and to store these data in a place inaccessible to others. The User (Buyer) is solely responsible for all actions performed on their behalf, i.e., using their login and password.
3. Order Placement, Pricing, and Exchange
3.1. The Visitor (Buyer) can place an order independently by clicking the "buy" and "place order" buttons or by calling the number indicated at the top of the page. After placing an order, the Buyer will receive a confirmation message regarding the order and the availability of the goods, or the expected date of receipt of the goods if they are out of stock. When placing an order by phone, the confirmation will be made via telephone communication.
3.2. If the goods indicated on the Site are not available due to technical issues or other reasons beyond the Administration's control, the specified order is canceled in whole or in part, and the Visitor (Buyer) is informed by sending a message.
3.3. By joining this Agreement and placing an order, the User (Buyer) confirms that they have read the sections of the Site "Delivery and Payment", "About Us", agree with them, and fully understand them. The Administration reserves the right to change the delivery time of the order with prior notice to the User.
3.4. The Visitor (Buyer) agrees that the price of the goods, their assortment, and quantity in the "cart" are only valid at the time of forming the "cart" and may change if the purchase is not finalized by clicking the "place order" or "buy" button.
3.5. The Visitor (Buyer) agrees that the purchased goods are not subject to exchange or return in the following cases:
3.5.1. More than 14 calendar days have passed since the purchase of the goods;
3.5.2. Less than 14 calendar days have passed since the purchase of the goods, but the goods have been used, the packaging integrity and/or completeness has been violated, labels/tags are missing, etc.
- The goods belong to the list of goods that are not subject to exchange and return, according to the Resolution of the Cabinet of Ministers of Ukraine No. 172 of March 19, 1994 (as amended) http://zakon4.rada.gov.ua, namely:
Food products, medicines and medical supplies, hygiene products.
Non-food products:
- Perfumery and cosmetic products;
- Combs, hairbrushes, and massage brushes;
- Gloves;
- Goods in aerosol packaging;
- Manicure and pedicure tools (scissors, files, etc.).
3.5.3. The Visitor (Buyer) refuses to provide photo or video materials of the defective and/or faulty, in their opinion, goods.
3.6. By this Agreement, the User (Buyer) confirms their awareness that only new goods that have not been used and have no signs of use: scratches, chips; must be returned or exchanged. The complete set of goods, packaging integrity, labels, markings, and the User (Buyer) must have the original document confirming the purchase of the respective goods. Violation of any of these points gives the Administration the right to refuse the Visitor (Buyer) in exchange or return of goods.
3.7. When ordering goods on the site, the User (Buyer) confirms their consent to receive information about the production date, shelf life of the product in the format provided by the brand manufacturer, printed on the product packaging or other markings of the manufacturer.
3.8. When ordering goods on the site, the User (Buyer) confirms their consent to combine orders placed for one recipient in one package and receive one parcel. In case of order consolidation, the User (Buyer) will be notified by an email to the email address specified when placing the order.
3.9. In case of the Visitor's (Buyer's) refusal of the goods, the Administration returns the amount paid by the Buyer, except for the Seller's costs for delivery from the Buyer of the returned goods.
4. Liability of the Parties
4.1. The Administration is not responsible for any errors, typographical errors, and inaccuracies that may be found in the materials contained on this website. The Administration makes every effort to ensure the accuracy and reliability of the information on the online store website. All information and materials are provided "as is", without any guarantees, either express or implied.
4.2. The Administration is not responsible for the statements and opinions of the Visitors (Buyers) of the website, left as comments or reviews.
4.3. The Administration is not responsible for any unlawful actions of the Visitor (Buyer) regarding third parties or the actions of third parties regarding the Visitor/Buyer.
4.4. The Administration is not responsible for any damage, losses, or expenses (actual or possible) that arose in connection with this website, its use, or inability to use.
4.5. The Administration is not responsible for the loss by the User (Buyer) of access to their account — an account on the site https://beautybyvi.ca (loss of login, password, other information).
4.6. For the above reasons, the Administration reserves the right to delete information posted on the Site and take technical and legal measures to terminate access to the online store for users (Buyers) who create problems in using the online store by other Visitors (Buyers), Users (Buyers) in case of any dishonest abuses on their part when ordering goods that are not intended for purchase, or Visitors (Buyers) who violate the requirements of the Agreement. Such blocking is at the discretion of the administration without subsequent notification of such Users (Buyers).
4.7. The website administration is not responsible for:
4.7.1. Delays or failures in the process of the transaction due to force majeure, as well as any case of malfunction in telecommunication, computer, electrical, and other related systems.
4.7.2. Actions of transfer systems, banks, payment systems, and for delays related to their operation.
4.7.3. Proper functioning of the Site if the Visitor (Buyer) does not have the necessary technical means for its use, and is not responsible for providing users with such means.
4.8. The parties are responsible for fulfilling their obligations according to the current legislation of Ukraine and the provisions of this Agreement.
4.9. The Seller or Buyer is released from liability for full or partial failure to fulfill their obligations if
